Monitor Alert ("MA") Terms and Conditions
Following are the Monitor Alert Terms and Conditions of Use
and pricing details. These terms of use should be read in
conjunction with our General Terms of Use and Disclaimer,
Software Licence Agreement and our Privacy Policy.
1. General Use
1.1 Your use of the Masicorp Monitor Alert software and
service is governed by the Software Licence Agreement and
the following terms and conditions.
1.2 You must register and establish an account to use Monitor
Alert. This is done from within the MA application.
2. Access
2.1 We aim, but do not promise, to provide you with continuous
or fault-free services.
2.2 You acknowledge that the internet is an unreliable medium.
2.3 We do not guarantee that the alerts generated by Monitor
Alert will be accessible or able to be transmitted at all
times and fault-free.
3. Services and Network
3.1 The performance of Monitor Alert is subject to Masicorp’s
network capacity restrictions.
3.2 We are able to cancel, suspend or restrict your use
of Monitor Alert at any time and for any reason, including,
if:
a. we reasonably believe that network traffic generated
by Monitor Alert is impairing, interfering with or damaging
our network; or
b. we need to do maintenance to our network; or
c. we need to protect our interest or our electronic systems;
or
d. you do anything which is not permitted as indicated in
clause 5; or
e. your pre-paid account does not have sufficient credit
to cover charges incurred as a result of your use of the
MA service.
4. Monitor Alert Message Size, Content and Quantity
4.1 In respect of SMS alerts you will be able to send messages
of up to 155 characters of text that comply with the standard
GSM alphabet.
4.2 In respect of Email alerts you will be able to send
messages of up to 500kb in size per message.
4.3 You send Monitor Alert messages at your own risk. We
take no responsibility for the content of Monitor Alert
messages you send or access. You must comply with all applicable
laws in using Monitor Alert. We do not keep records of Monitor
Alert messages nor are we under an obligation to monitor
such messages. We cannot guarantee that Monitor Alert messages
will be delivered successfully.
4.4 The quantity of messages (alerts) you are able to send
is governed by your available credit divisible by the costs
and number of alert messages you wish to send (or are generated
by MA according to your configuration of the same).
5. Prohibited Uses of Monitor Alert
5.1 You must not use Monitor Alert to send messages (alerts)
that:
a. are indecent, obscene or otherwise offensive;
b. defame another person;
c. contravene any applicable laws;
d. are misleading or deceptive as to your identity;
e. interfere with any other person’s use of Monitor
Alert or Masicorp’s network
5.2 You are not permitted to use Monitor Alert for the purposes
of:
a. advertising products or services;
b. resale of Monitor Alert or other commercial use unless
authorised in writing by the CEO of Masicorp; or
c. sending messages that are not Personal or related to
your Business or as authorised be your Employer (that is
the user of MA) or Customer.
6. What are the Charges and how Payments can be
Made for Monitor Alert
6.1 Monitor Alert has a number of components for which charges
apply as itemised under the heading Pricing at the bottom
of this page. A summary of the MA components for which a
charge or fee applies follows:
a. MA software subscription licence fee according to the
number of network devices within a customer's network, which
is paid monthly from the commencement of software and services
use via automatic payment or manual payment; and
b . Monthly alert charges in preset dollar amounts pre-paid
on a monthly basis.
6.2 The software subscription licence fee is non-refundable
where you complete the registration and payment form from
within the software.
6.3 You may choose to terminate your subscription at any
time by one of the following methods:
a. By selecting "cancel automatic payment" on
the Automatic Payment form from within the MA software;
or
b. By not processing any further manual payments from within
the Manual Payment form from within the MA software.
6.4 You will be charged for using Monitor Alert and for
the alerts generated at the rates indicated in the table
at the bottom of this page under the heading Pricing. Charges
apply per message per intended recipient, irrespective of
whether the message is successfully delivered to, or received
by, the intended recipient. Messages sent to a group will
be treated as individual messages sent to each of the group’s
members and charged accordingly.
6.5 You acknowledge that delivery will be unpredictable
and unreliable with the sending of Email alerts where the
message exceeds 500kb in size.
6.6 In respect of sending SMS alerts where the message exceeds
the 155 character limit, it will be automatically broken
into individual messages of up to 155 characters and sent
as separate messages. You will then be charged according
to the number of Monitor Alert SMS messages sent.
6.7 In respect of SMS alerts if the intended recipient of
your message:
a. has not turned on their mobile handset; or
b. is not in a mobile service area; or
c. has a mobile handset which is full of messages or otherwise
out memory; or
d. no longer has a mobile service capable of receiving Monitor
Alert messages;
then we will still charge you at the time that the message
is delivered or after 7 days of attempting to deliver the
message, whichever is the earlier.
7. Pricing Details for Masicorp Monitor Alert
7.1 Once you elect to continue to use MA beyond the trial
period (if any) then charges, as indicated in clause 6 and
within the table at the bottom of this page under the heading
Pricing, will apply.
7.2 Masicorp's business is domiciled in the State of New
South Wales, Australian and all charges / pricing is in
Australian dollars unless otherwise stated.
8. Deactivation at End of Subscription Period 8.1 The software is provided to you on the understanding
and acknowledgment that it may contain technology which
deactivates and disables the software if your subscription
is not renewed or there is insufficient credit available
for the services and alerts attempted or you are found to
be in breach of the software licence agreement and other
terms of use.
8.2 If the software is not renewed by the end of the required
period, the software may continue to operate but with impaired
functionality and / or you may not be permitted to send
all or some alerts.
9. GSM Mobile Number Details
9.1 In respect of SMS alerts you acknowledge that the Masicorp
GSM system number and the GSM number you have nominated
within the Monitor Alert configuration will appear in any
alerts MA sends.
10. Login Details and Password
10.1 To activate the features of Monitor Alert you will
need to establish an account and password.
10.2 You are responsible for maintaining the confidentiality
of your password and account information and are fully responsible
for all conduct carried out under this password and account.
10.3 Masicorp is not liable for any loss of confidentiality
or for any damages arising from your failure to comply with
these security measures.
10.4 You are requested to promptly report to Masicorp any
unauthorised use of your account and password.
11. GST and Tax Invoice
11.1 If GST applies or is introduced on any supply we make
to you and you are domiciled in Australia then you are required
to pay the GST amount at the prevailing GST rate. The GST
amount must be paid by you without deduction or set-off.
11.2 Whenever a payment is made by you either manually or
through our automatic payment system from within the MA
software then we will issue you a Tax Invoice for any supply
on which GST is payable / applicable.
11.3 Prices indicated in the pricing tables below do not
include GST. Where GST is applicable it will be added at
this time of purchase.
12. Support
12.1 We will provide support for all of our products and
services for as long as they are supplied to you. In order
to request support you must log your fault or support request
via our forum.
12.2 Where we supply you with equipment that is faulty or
defective or becomes faulty during its warranty period through
normal operation then we will replace or repair that equipment
(at our complete discretion) at no cost to you.
12.3 Where equipment becomes faulty and is outside its warranty
period, then we may charge you for rectifying the fault.
13. Excessive and Unusual Use
13.1 We do not promise to monitor your service for excessive
and unusual usage. However, if we notice that your service
is being used in an excessive and unusual way, we may suspend
your service to prevent you incurring unexpected charges.
We will use reasonable steps to contact you prior to the
suspension of the service. Excessive and unusual use may
include but is not limited to the following examples:
a. where an unusually large volume of alerts are being made
from your service; or
b. excessive use of data and other messaging services.
13.2 If we do suspend your service in accordance with this
clause 13, then you are still liable to pay us any charges
incurred for any excessive or unusual usage.
14. Personal Information
14.1 We may collect, use and disclose your personal information
in accordance with our Privacy Policy.

of New South Wales and both parties submit to the non-exclusive
jurisdiction of the courts of this State.

What is a Monitoring Event?
A Monitoring Event is each monitoring instance that is
configured via the MA client software and is stored in
the MA database. For example if you wish to monitor an
IP address; you would configure this via the MA client,
this would count as one Monitoring Event. If you then
wish to monitor a system's event log; you would once again
configure this via your MA client and this would count
as another Monitoring Event. And so on .....
When deciding on how many Monitoring Events that you may
require, consider the number of environment parameters
you would like to monitor, the number of devices (e.g.
PC's, servers, printers, routers, etc.) you have, which
of those you would like to monitor and the various forms
of monitoring you would like to perform e.g. event logs,
IP, temperature, hard disk drives, email, etc. Of course
not all devices need to be monitored; consider which devices
are mission critical and work from there and don't forget
to consider the environmental parameters you would like
to monitor (e.g. temperature, light, humidity, etc.).

note that you can easily change your subscription arrangement
(from within the MA client software) at anytime thereby
either increasing or decreasing the number of Monitoring
